Schuyler Expands Smoking Restrictions

Schuyler County office building properties are now smoke-free, but Monday night's vote to enact the ban was not unanimous.

"This is an imposition on our employees who have a short break and are addicted to cigarettes," Legislator Glenn Larison, R-Odessa, said.

Before Monday's action, smoking cigarettes was prohibited within 50 feet of the doors at the County Office Building and Mill Creek Center in Watkins Glen and at the Human Services Complex in Montour Falls. The county's Seneca Harbor Park is not affected.

Larison and Legislator Philip Barnes, R-Watkins Glen, who proposed the property-wide ban, both agreed that the 50-feet rule is not being enforced. Larison, however, said the expanded prohibition will not be enforced, either.

Barnes disagreed.

"No one is respecting it. But now, it will be simple peer pressure," Barnes said, noting it will be easier to point out to smokers that the whole property is smoke-free.

Schuyler Hospital and The Arc of Schuyler are among businesses in the county that established property-wide smoking cigarettes bans.

"Smoking kills. Why would we not do everything possible to keep people alive?" Legislator Barbara Halpin, R-Odessa said.

During the public comment period, county employee Charlotte Dickens spoke against the change.

"It will be another instance of taking personal freedoms away from employees and others. Smoking outside does not harm," Dickens said.

Barnes said he had heard only positive reactions from the public and employees about the campus-wide ban.

"It's time we institute this," Legislature Chairman Dennis Fagan, R-Tyrone, said.

The ban is effective immediately.

In other business, lawmakers approved a permit for Watkins Glen International to host a three-day music festival and wine festival in July and the NASCAR race in August.

County Administrator Timothy O'Hearn said the county's review of the events determined the three events do have environmental impact, but it's temporary and is backed up by mitigation plans.

For example, he said the NASCAR race involves the storage of petroleum products, but WGI has a plan in case of a disaster involving those products.

The three-day Phish festival in July will exceed local ambient noise levels, O'Hearn said, but the stage will be positioned to have minimal impact on neighbors and the noise is temporary. O'Hearn noted that expected noise levels from the festival will be less than levels from the NASCAR weekend.
