Lawmaker Makes Case To Ban Smoking On NV Campuses

University and college students may now have a choice when they go outdoors on state university and college campuses: Smoke over there or don't smoke cigarettes at all.

Current law bans smoking cigarettes in many indoor locations. Assemblyman Paul Aizley, D-Las Vegas, told the Senate Judiciary Committee Sunday that support for smoke-free college campuses is building.

"Ten years ago I would not have brought this bill forward, but we have heard repeatedly over the past few years that secondhand smoke cigarettes is a killer," he said.

AB128 would expand current law by applying the no-smoking cigarettes law to include outdoor areas. The bill would allow campuses to establish designated smoking cigarettes zones as long as they are not along major walkways or areas.

"My intention is not to make little villains out of the people smoking cigarettes on campus," Aizley said. He said his goal is to create a smoke-free environment, but "the great outdoors is a smoking cigarettes area."

The latest version of the bill does away with cost concerns that had plagued the initial version. The original bill proposed making it a misdemeanor to smoke cigarettes in nonsmoking cigarettes campus areas. Aizley said the cost of issuing citations weighed the bill with a fiscal note. The current version requires smokers to extinguish their buy cigarettes if they're caught smoking cigarettes in off-limits locations.

The Senate Judiciary Committee heard the bill Sunday even though the measure has not yet passed out of the Assembly. The committee can hear bills but cannot act on them until the houses swap custody.

This is one of several smoking cigarettes bills that have wound their way through the Legislature this session. AB571 cleared the Assembly on Sunday with a 23-19 vote. The bill would allow free-standing bars that allow smoking cigarettes to also serve food. Current law restricted these establishments to abbreviated menus that could include pretzels and snacks. Tavern owners have said restrictions have inflicted serious financial harm. The bill now heads to the Senate.

Lawmakers also approved AB170 earlier this session. The bill requires cheap cigarettes retailers to post the dangers that come with smoking cigarettes during pregnancy. Gov. Brian Sandoval signed the bill into law May 31.
