City Will Initially Focus On Educating Businesses About Springfield Smoking Ban
City officials tasked with enforcing Springfield's new smoking cigarettes ordinance expected some grumbling.
But they didn't plan to slap defiant smokers with tickets when the ban took effect at 12:01 a.m. this morning.
Education, rather than enforcement, will be the focus initially, said City Attorney Dan Wichmer. "The goal all along has been the public health."
The law, which generally prohibits smoking cigarettes inside any building where people work or the public has access, will be enforced by the Springfield-Greene Health Department on a complaint basis.
There were no plans to send employees out this morning to conduct compliance checks, but Assistant Director of Health Clay Goddard said staff would follow up any complaints filed with the city's public information office.
"If we've got evidence that smoking cigarettes occurred, that's going to start our process," he said.
Goddard said a first complaint of illegal smoking cigarettes will be followed up with a phone call to the business to talk about the new law and requirements for compliance.
After a second complaint, "they'll receive a certified letter" outlining the potential consequences -- fines or even lost business and liquor licenses -- of continued non-compliance, he said.
"Those are tools we don't ever want to use," Goddard said. "Our intent is to educate, re-educate businesses, let them know what the consequences of continuing to allow smoking cigarettes would be ... We're gonna give every business owner a chance."
Goddard said he expected the vast majority of businesses to make the conversion without any problem, but acknowledged the midnight transition could "be hard for some of the establishments to manage."
"There are going to be a few out there that have strong feelings about this," he said. "We'll work with them to ensure compliance."
